Diritto di Recesso

Ai sensi degli articoli 52 e seguenti del D.Lgs. 206/2005 (Codice del Consumo) e della Direttiva 2011/83/UE, il Cliente consumatore ha diritto di recedere dal contratto di acquisto, senza dover fornire alcuna motivazione e senza penalità, entro 14 (quattordici) giorni di calendario dal giorno in cui egli o un terzo, diverso dal vettore e da lui designato, acquisisce il possesso fisico dei beni.

Come esercitare il diritto di recesso

Per esercitare il diritto di recesso, il Cliente deve inviare una dichiarazione esplicita della propria decisione di recedere (ad esempio via email) ai seguenti recapiti:

Effetti del recesso e rimborsi

In caso di recesso, TIMI SHOP SRLS rimborserà tutti i pagamenti ricevuti dal Cliente per i beni restituiti, incluse le spese di consegna standard (se applicabili), senza indebito ritardo e comunque entro 14 giorni dalla data in cui è stata ricevuta la comunicazione di recesso.

Il rimborso sarà effettuato utilizzando lo stesso mezzo di pagamento impiegato per la transazione iniziale (inclusi i pagamenti effettuati tramite Klarna), salvo diverso accordo espresso tra le parti.
TIMI SHOP SRLS potrà trattenere il rimborso finché non avrà ricevuto i beni oppure finché il Cliente non avrà dimostrato di averli rispediti, a seconda di quale situazione si verifichi per prima.

La restituzione deve avvenire senza indebiti ritardi e comunque entro 14 giorni dalla data in cui il Cliente ha comunicato la propria decisione di recedere.

Salvo il caso di prodotto difettoso o errato, i costi diretti della restituzione sono a carico del Cliente.
Nel caso di prodotto errato o non conforme, le spese di reso saranno a carico del venditore.

Il Cliente è responsabile della diminuzione di valore dei beni risultante da una manipolazione diversa da quella necessaria per stabilirne la natura, le caratteristiche e il funzionamento.

Eccezioni al diritto di recesso

Per motivi di igiene e tutela della salute, non è possibile esercitare il diritto di recesso su prodotti sigillati che siano stati aperti dopo la consegna (ad esempio profumi, cosmetici o tester privi di sigillo o utilizzati anche solo parzialmente).
Il diritto di recesso resta valido in caso di prodotto difettoso o non conforme all’ordine.

Right of Withdrawal (14 Days)

Pursuant to Articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code) and Directive 2011/83/EU, the consumer has the right to withdraw from the purchase contract, without providing any reason and without incurring any penalty, within 14 (fourteen) calendar days from the day on which he or a third party, other than the carrier and indicated by him, acquires physical possession of the goods.

How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the Customer must send an explicit declaration of their decision to withdraw (for example, via email) to the following contact details:

Effects of Withdrawal and Refunds

In the event of withdrawal, TIMI SHOP SRLS will refund all payments received from the Customer for the returned goods, including standard delivery costs (if applicable), without undue delay and in any case within 14 days from the date on which the withdrawal notice was received.

The refund will be made using the same payment method used for the original transaction (including payments made via Klarna), unless otherwise expressly agreed by the parties.
TIMI SHOP SRLS may withhold the refund until it has received the goods or until the Customer has provided proof of having sent them back, whichever occurs first.

The goods must be returned without undue delay and in any case within 14 days from the date on which the Customer communicated their decision to withdraw.

Unless the item is defective or incorrect, the direct cost of returning the goods shall be borne by the Customer.
In the case of an incorrect or non-conforming product, the return shipping costs will be borne by the seller.

The Customer is responsible for any reduction in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions to the Right of Withdrawal

For reasons of health protection and hygiene, the right of withdrawal cannot be exercised for sealed products that have been opened after delivery (for example, perfumes, cosmetics, or testers that are unsealed or partially used).
The right of withdrawal remains valid in the event of a defective or non-conforming product.
